AGREEMENT TO OUR LEGAL TERMS

We are TollTracker ("Company," "we," "us," "our"). We operate tolltracker.eu, as well as any other related products and services that refer or link to these legal terms ("Legal Terms") (collectively, the "Services").

These Legal Terms constitute a legally binding agreement between you, personally or on behalf of an organization ("you"), and TollTracker, regarding your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.

IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Additional terms that may be posted in the Services from time to time are expressly incorporated herein by reference. We reserve the right, at our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason.

The Services do not offer users the ability to submit or post content. We may provide you with the opportunity to create, submit, post, display, transmit, or distribute content and materials ("Materials").

You and TollTracker agree that we may access, store, process, and use any information and personal data you provide. By submitting suggestions or other feedback regarding the Services, you agree that we may use such feedback for any purpose without compensation to you.

7. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to:

monitor the Services for violations of these Legal Terms;
take appropriate legal action;
limit access to your Materials;
remove from the Services files and content of excessive size.

8. TERM AND TERMINATION

These Legal Terms remain in full force and effect while you use the Services. WE RESERVE THE RIGHT TO DENY ACCESS TO THE SERVICES TO ANY PERSON FOR ANY REASON WITHOUT NOTICE.

9. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the content of the Services at any time without notice. We cannot guarantee that the Services will be available at all times.

10. GOVERNING LAW

These Legal Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria. TollTracker and you irrevocably agree that the courts of Bulgaria have exclusive jurisdiction to resolve any dispute.

11. DISPUTE RESOLUTION

Informal Negotiations

To expedite resolution and control the costs of any dispute related to these Legal Terms, the Parties agree to first attempt to negotiate any dispute informally for at least 30 days before starting arbitration.

Binding Arbitration

Any dispute arising out of or in connection with these Legal Terms shall be referred for final resolution through arbitration. The number of arbitrators shall be 1. The seat of the arbitration shall be Sofia, Bulgaria. The language of the proceedings shall be Bulgarian.

12. CORRECTIONS

There may be information in the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct errors and update information at any time without notice.

13. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES.

14. LIMITATIONS OF LIABILITY

UNDER NO CIRCUMSTANCES SHALL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES.

15. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, or claim arising out of:

use of the Services;
violation of these Legal Terms;
violation of the rights of a third party;
any harmful act toward another user of the Services.

16. USER DATA

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services. You are solely responsible for all data you transmit.

17. ELECTRONIC COMMUNICATIONS AND SIGNATURES

Visiting the Services, sending emails, and completing online forms constitute electronic communications. You agree to receive electronic communications.

18. MISCELLANEOUS

These Legal Terms and any policies constitute the entire agreement between you and us. Our failure to exercise a right does not constitute a waiver of such right.
